Grant of anticipatory bail is rejected on account of fake and forged E-way bill generated by the petitioner

Anticipatory Bail --The petitioner filed petition u/s 438 of the CrPC for grant of anticipatory bail for offence u/s 420, 467&471 of IPC on the ground that a fake E-way bill was generated for an amount of Rs.1,79,200/-. The petitioner submitted that GST of Rs.9,600/- was paid, hence there was no question of the E-way bill being fake. The respondent submitted that for the purpose of creating false evidence in the case of dishonoring of cheques, had paid GST to the tune of Rs.9,600/-. The e way bill was generated, however, material was not supplied. The driver of the vehicle has stated that he never delivered any such goods to the complainant. The complainant submitted that E-way bill was rejected by him on 05.01.2020. The court observed that the petitioner is not able to explain as to what was the necessity of depositing the GST on the rejected bill. Held that:- The Hon’ble High Court dismissed the petition.
