The applicant is ordered to be released on regular bail

Section 132 of the CGST Act, 2017— Bail —– The applicant prayed for regular bail for offence under Section 132 of Act. The applicant counsel submitted that considering the nature of the offence, the applicant may be enlarged on regular bail by imposing suitable conditions. The respondent counsel opposed grant of regular bail looking to the nature and gravity of the offence. The court observed that the applicant is in jail since 12.03.2019, investigation is concluded and chargesheet is filed and maximum punishment prescribed for the alleged offence is 5 years. The Court relied on the decision of the Hon'ble Apex Court in the case of Sanjay Chandra Vs. Central Bureau of Investigation, reported in [2012] 1 SCC 40. Held that:- The Hon’ble High Court allowed the present application and ordered that the applicant be released on regular bail on executing a personal bond of Rs. 10,000/- with one surety of the like amount to the satisfaction of the trial Court and subject to certain conditions.
