The petitioner is ordered to be released on regular bail, subject to his furnishing bail/surety bonds to the satisfaction of trial Court/Duty Magistrate concerned and subject to him not being required in any other case.

Section 132 of the CGST Act, 2017 --- Bail – The applicant sought regular bail in respect of Complaint No.85/2022 dated 10.03.2022, under Sections 132(i) (c) & (e) read with Section 16(2) of the Act. The counsel for the petitioner submitted that the petitioner is in custody since 07.05.2022. The sentence for offence alleged against the petitioner is 5 years and is triable by a Magistrate. Challan was presented on 06.07.2022, however, charges are yet to be framed. The court relied upon the judgment of Hon'ble The Supreme Court of India in the case of Sanjay Chandra v. CBI and observed that the petitioner is in custody since 07.05.2022; challan was presented on 06.07.2022, however, charges are yet to be framed; in all there are 20 witnesses; the trial is likely to take a considerable time, his further detention behind bars would not serve any useful purpose.

Held that:- The Hon’ble High Court allowed the application subject to certain conditions.
