HC has no adjudication on the question whether the petitioner is eligible for grant of alternate accommodation.

Contempt petition — Eligibility for grant of alternate accommodation — The petitioner filed appeal as he has been held ineligible for grant of alternate accommodation. Further in the event the petitioner is held eligible for alternate accommodation, he is willing to vacate the subject structure. The Court observed that if this statement is found to be incorrect, the Municipal Corporation is granted permission to move the Court for vacating this order.
Held that:- The Hon’ble High Court directed the Appeal on the issue of eligibility for grant of alternate accommodation shall be decided by the Mumbai Municipal Corporation within a period of four months; if the petitioner is held to be eligible for grant of alternate accommodation, the same shall be offered to the petitioner; in the event the Appeal is dismissed, the structure of the petitioner shall not be demolished for a period of three weeks. — Jamiluddin Aminuddin Siddiqui Vs Municipal Corporation For Greater Mumbai [2018] 02 TAXLOK.COM 397 (Bombay)
