This Court is of the opinion that this is a fit case to exercise the discretion and enlarge the applicant on regular bail.

Section 132 of the CGST Act, 2017— Bail Application—–The applicant filed bail application u/s 439 of the Code of Criminal Procedure, for regular bail for the offences u/s 132(1)(a)(b)(c)(d) of the Act. The applicant counsel submitted that considering the nature of the offence, the applicant may be enlarged on regular bail by imposing suitable conditions. The respondent counsel opposed grant of regular bail looking to the nature and gravity of the offence. The court observed that the applicant is in jail since 09.06.2020. Investigation is concluded and the prosecution is launched. The respondent counsel is unable to bring on record any special circumstances against the applicant. Held that:- The Hon’ble High Court allowed the present application and directed that the applicant be released on regular bail on executing a personal bond of Rs. 10,000/- with one surety of the like amount to the satisfaction of the trial Court and subject to certain conditions.
