Section 54 of the CGST Act, 2017 —Refund – The petitioner challenged an order of rejection of refund dated March 2, 2020. The rejection order was passed without granting any hearing to him. The respondent counsel submitted that by a letter dated December 18, 2019, certain deficiencies in the application filed under Section 54 of the Act had been notified to the petitioner, which is still required to be rectified.
Held that:- The Hon’ble High Court directed the respondent to grant one week time to the petitioner to rectify the deficiencies and the petitioner shall be required to rectify the deficiencies within one week and thereafter, the respondent pass a reasoned order after giving an opportunity of hearing to the petitioner within seven weeks.
