Bail application— Section 132 of CGST Act— In the instant case, petitioner has prayed for grant of regular bail for the offence registered under Sections 419, 420, 467, 468, 471, 34 IPC, read with Section 132(1)(b)(c)(e) and (f) of the Jharkhand Goods & Service Tax Act, 2017.
It is alleged that proprietor of M/s Maa Bhawani Enterprises has taken input credit facilities of Rs. 5,36,66,982.68/- on the basis of forged document.
the petitioner has submitted that admittedly the proprietorship of M/s Maa Bhawani Enterprises is in the name of Jai Ram Mahato and it is surprising that while Jai Ram Mahato was in custody, his statement was recorded under Section 161 Cr.P.C. where he has alleged that this petitioner, Yogendra Singh was doing entire business for the M/s Maa Bhawani Enterprises and on the basis of that petitioner, Yogendra singh has been made accused and he has been taken into custody on 28.02.2020.
Held that— This case may be heard along with bail application bearing B.A. No.4348 of 2020 preferred by coaccused, Jai Ram Mahto though the same is still defective.
