Transfer Petition for transfer of the writ petitions pending in the High Courts of Bombay, Gujarat and Karnataka, to the Delhi High Court.

Anti-Profiteering — Section 171 of the CGST Act, 2017—The National Anti-Profiteering Authority has filed this Transfer Petition for transfer of the writ petitions pending in the High Courts of Bombay, Gujarat and Karnataka, to the Delhi High Court. The counsel for the petitioner submitted that the respondents-writ petitioners have challenged the constitutional validity of Section 171 of the Act, the benefit not being passed to the eventual customers. Around 40 such writ petitions are being heard by the Delhi High Court. He relied this Court’s order dated 19.02.2020 in the T.P. (C) Nos. 290-292/2020 [2020] 21 TAXLOK.COM 046 (SC) to point out that similar writ petitions pending in the Delhi, Bombay, Punjab and Haryana High Courts, were transferred.
